A 10 year old Pune boy takes his father to court

Pune: In one of the rarest instances, a 10-year-old Puneite has filed a petition against his father in a Pune court alleging his father of not bearing his educational expenses. His father is divorced from his mother.

This is touted to be the first such incident where a male has used Protection to Women from Domestic Violence Act, ever since it was enacted in 2005.

The incident broke the age-long myth that only female members of the society can resort to PWDVA to seek justice on domestic matters. Lawyer and human rights activist Assem Sarode stated that there has been a specific mention of the word 'child' in Section 2 of PWDVA and that is used in a neutral way.

The lawyer, who is also representing the child, went on to add that any person below the age of 18 can take help from this legislation. This also includes stepchildren and foster or adopted children of any gender.

The boy's parents were married in July 1999 and he was born in 2000. It was in May 2005 when the couple got divorced. Presently, the boy is going through a tough phase since he is not getting enough financial support from his father.

The court had asked his father to pay Rs 500 per month for his son's education, but he has failed to keep his word.
