| New Delhi: In an effort to make it easier for ladies to adopt the Union Cabinet is supposed to consider making some changes to the Hindu Adoption Maintenance Act of 1956 as well as the Guardians and Wards Act of 1890.
As of now, in case of a couple adopting a kid the male partner is deemed the guardian. However, as per the proposed changes the issue of guardianship would be rendered gender neutral. It would also be easier for people who are separated but not formally divorced from their spouses, to adopt a child. However, consent from the spouse is a must in this case.
As per the Central Adoption Resource Agency, at present there are 6,000 children who are eligible for adoption in India. However, activists are of the opinion that the number could be higher given the immense number of kids who are there at the streets as well as children of sex workers and immigrant recruits. Even though it is acknowledged that they need help not much has been done for the same.
Member of Law Commission, Kirti Singh has welcomed both the proposals but also states that the legal system needs to be overhauled. NGOs have said any change in government policies regarding adoption is welcome but it should also be seen that they are not misappropriated. They opined that it could only be achieved through a proper monitoring body. |
