Poverty could have a say on criminal and murder cases: Supreme Court

New Delhi: The Supreme Court has said that the economic background of an accused in a criminal case, especially murders as far as deciding on a life sentence or death penalty was concerned. They have said this would be applicable in case of even the rarest of crimes. It is expected that this decision of the apex judicial body of India would create a lot of furore in a country where law is supposed to be applicable to all irrespective of their social and economic backgrounds.

The court has iterated that if the accused is economically disadvantaged then it would be taken into consideration while deciding on the sentence. This would be applicable in cases, which experts say, deserve a sure shot death penalty.

The order was given by a Bench made up of Justice H L Dattu and Justice P Sathasivam. This decision was taken during a case where two members of a gang of robbers had been accused of murdering four people in 1995. The Bench also observed that the accused have been in judicial custody since 1996. They have also been given a death sentence in 2005 itself. This was when a trial court had passed their verdict on these convicts.
