Indian Preamble

The Indian Preamble states:

"WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN, SOCIALIST, SECULAR, DEMOCRATIC REPUBLIC and to secure to all its citizens:

JUSTICE, social, economic and political;

LIBERTY of thought, expression, belief, faith and worship;

EQUALITY of status and of opportunity;

and to promote among them all

FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;

IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION".

The Indian Preamble is not necessarily a part of the Indian Constitution and cannot be enforced in a court of law, but as per the need of the situation, the Preamble of India can be well used to interpret certain aspects of the Indian Constitution which lay ambiguous at times and several interpretations can be evolved from the same. The Indian Preamble can be used as the operative and interpretative tool in case of the open ended and ambiguous laws if present in the Indian constitution.

The preamble highlights some of the fundamental rights and duties that come as a birth right to every citizen however, it has been announced and accepted that the Indian Preamble in any form is neither a rule nor can it be enforced legally.

There have been amendments made in the Preamble of India, after it was finally approved. In the original draft of the Indian Preamble the "Secular" and the "Socialist" words were not included and it was done as per the 42nd Amendment.

The words mentioned in the Indian Preamble stands significant for one and all and in all respect. The Preamble states the power of the law and the limitation where the laws made by the people for themselves cannot be put to any misuse. The last line of the Indian Preamble also mentions the date when the Indian constitution was adopted and came into being.

On the whole, the Preamble of India states that India is a supreme and an independent country and people residing in it enjoys social equality irrespective of caste, creed and sect. The right and power of electing the Government lies with the people of the country and each person above the age of 18 has the right to vote and to choose a government to rule the country.

On the whole Preamble acts the guiding factor for any sort of ambiguity in the Indian constitution and held as the prime of the Indian constitution. The Preamble of India is an important aspect while talking on facts about India.
