Offences Against the State
Offences Against the State section of Indian Penal Code deals with any kind of offences against the state. It encompasses total 12 sections beginning from Sections 121 to 130 and 121 and 124. In the year 1870, these sections were added to the Indian Penal Code. Let's have a look to these sections-
- Section 121. It is the first section under the Offences Against the State. This section describes as Waging or attempting to wage war or abetting waging of war against the Government of India: Whoever wages war against the Government of India, or attempts to wage such war, or abets the waging of such war, shall be punished with death, or imprisonment for life, and shall also be liable to fine.
- Section 121-A. This section of Indian Penal Code depicts "Conspiracy to commit offences punishable by Section 121: Whoever within or without India Conspires to commit any of the offences punishable by Section 121, or conspires to overawe by means of criminal force or the show of criminal force, the Central Government or any State Government, shall be punished with imprisonment for life, or with imprisonment of either description which may extend to ten years, and shall also be liable to fine."
- Collecting arms to wage war against the Government of India: According to section 122., if a person collects, arms, men or ammunition with an intention of wagging war against the Government of India, shall be punished with imprisonment or with fine. The imprisonment can be extended to ten years.
- Concealing facts with the intention to make wage war against the Government: If a person hides the existence of a design to wage war against the Government of India by any unlawful omission, shall be punished with imprisonment and it can be extended to ten years along with fine.
- Section 124. It describes, Assaulting President, Government, etc., with intent to compel or restrain the exercise of any lawful power: Whoever, with the intension of inducing or compelling the President of India or Governor of any state, to exercises or refrain from exercising in any manner any of the lawful powers of such President of Governor, assaults or wrongfully restrains, or attempts wrongfully to restrain, or overawe, by means of criminal force, or the show of criminal force, or attempts so to overawe, such President or Governor, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
